Durable Power of Attorney
A Power of Attorney authorizes a person of your choosing to handle your assets and financial affairs on your behalf. A Power of Attorney will list specific grants of authority to handle your affairs. This document is designed to allow the person you nominate to pay bills, manage investments, manage day-to-day finances, and act on your behalf in legal matters. A Power of Attorney is durable if it continues to be effective in the event of your incapacity. Accordingly, a valid Durable Power of Attorney may allow you and your loved ones to avoid an unwanted, costly, and intrusive guardianship to manage your finances during your incapacity. However, recent changes to the law make it easier for banks and other financial institutions to refuse to accept a valid Durable Power of Attorney.
Gulf Beaches Law, P.A. can help you to fully understand the benefits of creating a Durable Power of Attorney, the limitations of the document, and the legal obligations of the attorney-in-fact.
