Probate is a judicial process that distributes a deceased person’s assets to their beneficiaries. If the person has a will, then the personal representative who is named in that will applies to the court to have the will admitted to probate, gathers up the decedent’s assets and with the approval of the court distributes them to the beneficiaries. If the person doesn’t have a will, then someone can apply to the court to be named as the personal representative of the estate, gather up the decedent’s assets, and distribute the assets according to the intestate laws of the state of Florida.
